Beta Test Agreement

This Beta Test Agreement ("Agreement") governs participation in the Johnny Pilot™ beta testing program operated by RouteIQ LLC ("Company," "we," "our," or "us").
By accessing or using the Johnny Pilot™ beta platform, website, application, or related services (collectively, the "Beta Services"), you agree to the terms of this Agreement.
The purpose of the beta program is to test early-stage software, evaluate functionality, identify bugs and usability issues, gather user feedback, and improve the Johnny Pilot™ platform prior to broader release. The Beta Services are experimental and under active development.
The Beta Services are pre-release software and may contain bugs, inaccuracies, incomplete or incorrect results, experience outages, change substantially, or be discontinued at any time. Features available during beta are not guaranteed to be available in any future release.
To participate, you must be at least 18 years of age, have received an invitation or access code from the Company, and agree to the terms of this Agreement.
The Company grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Beta Services solely for evaluation and testing purposes during the beta period. You may not sublicense, sell, resell, transfer, assign, or otherwise commercially exploit the Beta Services.
You agree to provide honest, good-faith feedback about your experience with the Beta Services. Any feedback, suggestions, ideas, or recommendations you provide ("Feedback") shall become the exclusive property of the Company. You assign all rights in Feedback to the Company, and the Company may use Feedback for any purpose without compensation or attribution to you.
The Beta Services and all related materials are confidential and proprietary to the Company. You agree not to disclose, share, publish, or discuss any aspect of the Beta Services — including features, functionality, screenshots, performance, or data — with any third party without prior written consent from the Company. This confidentiality obligation survives termination of your beta access.
The Beta Services are provided "as is" and "as available" without warranty of any kind. The Company expressly disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
The Company does not warrant that the Beta Services will be error-free, uninterrupted, secure, or that results obtained from using the Beta Services will be accurate or reliable.
To the fullest extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages resulting from your use of or inability to use the Beta Services.
You acknowledge that driving, towing, and RV travel involve inherent risks. Johnny Pilot™ provides informational assistance only. You are solely responsible for all driving decisions, route choices, and safety judgments. The Company is not liable for any accidents, injuries, property damage, or other harm arising from your use of route, weather, or navigation information provided by the Beta Services.
By participating in the beta program, you consent to the collection and use of data related to your use of the Beta Services, including usage patterns, error logs, and feedback, for the purpose of improving the platform. Data collection and use is governed by our Privacy Policy.
The Company reserves the right to terminate your access to the Beta Services at any time, for any reason, without notice. You may terminate your participation at any time by ceasing use of the Beta Services and notifying the Company. Upon termination, all licenses granted herein immediately terminate.
All rights, title, and interest in and to the Beta Services, including all intellectual property rights, are and shall remain the exclusive property of RouteIQ LLC.
This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising under this Agreement shall be resolved exclusively in the state or federal courts located in Texas.
This Agreement constitutes the entire agreement between you and RouteIQ LLC with respect to your participation in the beta program and supersedes all prior agreements, understandings, negotiations, and discussions, whether oral or written.
